Terms and Conditions

Introduction

These Terms and Conditions ("Terms") govern the booking and use of accommodations, facilities, and services offered by California Beach Private Pools and Restaurant ("CBP", "we", "us", "our"), operating as California Beach Pansol at 965 National Highway, Pansol, Calamba, Laguna 4027, Philippines. By submitting a booking, paying a deposit, or staying at the property, you ("Guest") agree to be bound by these Terms.

These Terms apply alongside our Privacy Notice and the booking confirmation issued by Cloudbeds, our reservation platform. In the event of a conflict between these Terms and a specific written quotation or rate confirmation, the more recent written instrument controls.

1. Booking and reservation terms

1.1 How a booking is formed

A booking is formed when (a) we issue a written confirmation (email or Viber) holding a specific villa for specific dates, and (b) the Guest pays a deposit within the agreed hold window. Verbal inquiries, online chat conversations, and unanswered emails do not create a reservation.

1.2 Hold window

3-day option period; non-payment within the hold window releases the booking automatically. After release, the dates return to public inventory and may be booked by another party without further notice.

1.3 Deposit and balance

Unless a written quotation specifies otherwise:

  • Deposit: fifty percent (50%) of the total stay value, due within the hold window to confirm the booking.
  • Balance: the remaining fifty percent (50%) is due no later than seven (7) calendar days before the check-in date. For bookings made within seven (7) days of arrival, full payment is required to confirm.
  • Payment methods: bank transfer (BDO, BPI, or GCash), credit card via Cloudbeds, or other methods listed on the booking confirmation. Bank fees are borne by the Guest.

1.4 Modifications

Date changes are handled as a reschedule under the cancellation policy in section 2 below: with three (3) weeks (21 days) or more remaining before check-in, the booking may be rescheduled for a fee equal to fifty percent (50%) of the villa rate; with less than three (3) weeks remaining before check-in, the booking cannot be moved. Reschedules are subject to availability and any applicable rate differential, and we do not refund the difference if the rebooked stay is at a lower rate. 1.5 No-show

No-show = 100% charge. If the Guest does not arrive by 11:59 PM on the confirmed check-in date and has not communicated a delay, the reservation is treated as a no-show and the full stay value is forfeited.

1.6 Maximum occupancy

Each villa has a stated maximum occupancy. Exceeding the stated occupancy without prior written approval is grounds for refusing entry or terminating the stay without refund, and may incur an additional charge equal to the published per-head rate per excess guest per night.

2. Cancellation policy

The following cancellation policy applies to all bookings unless a different policy is stated in writing on the booking confirmation:

All booking payments are non-refundable, and no cancellation qualifies for a monetary refund. In place of cancelling, a booking may be rescheduled: with three (3) weeks (21 days) or more remaining before check-in, the booking may be rescheduled for a fee equal to fifty percent (50%) of the villa rate, subject to availability; with less than three (3) weeks remaining before check-in, the booking is forfeited and no reschedule is offered. Where an official weather advisory affects safe travel or the stay, the booking may be rescheduled once, without the rescheduling fee, to new dates within thirty (30) days of the original arrival date, subject to availability. Because payments are non-refundable, we strongly recommend travel insurance.

Because all booking payments are non-refundable, no refund of booking payments applies to a cancellation. Where a reschedule is available under the schedule above, the fifty percent (50%) rescheduling fee is payable before the new dates are confirmed and may be settled by bank transfer (BDO, BPI, or GCash) or the other methods listed on the booking confirmation. The Force Majeure provisions in section 4 below govern reschedules arising from weather and related events, where the rescheduling fee is waived.

Reschedule and cancellation requests must be sent in writing to [email protected] and are effective only when acknowledged in writing by our reservations team. Verbal requests are not sufficient.

3. Check-in and check-out times

Check-in and check-out times vary by villa to manage turnover and housekeeping. The applicable times are printed on the booking confirmation and are restated here for reference:

Early check-in and late check-out are subject to availability and may be granted at our discretion. Late check-out beyond one (1) hour past the stated time, without prior approval, incurs an additional half-day charge.

4. Force majeure (typhoon, seismic, and related events)

4.1 Why this clause exists

The Philippines experiences roughly twenty (20) named tropical cyclones per year, concentrated in the July–October window. The Pansol area in Calamba, Laguna sits within an active seismic zone (West Valley Fault, Macolod Corridor) and is exposed to flooding, landslides, and road closures along SLEX and STAR tollways. This clause names specific triggers and remedies so that disputes do not have to be resolved case-by-case under the general rule in Civil Code Article 1174 (caso fortuito).

4.2 Defined triggers

Force Majeure under these Terms means any one or more of the following, documented and in effect within seven (7) days of the Guest's scheduled arrival or during the stay:

  • Tropical cyclone wind signal: PAGASA Tropical Cyclone Wind Signal (TCWS) No. 2 or higher raised over Laguna, Batangas, Quezon, or Metro Manila.
  • Rainfall warning: PAGASA red rainfall warning (greater than 30 mm per hour) over CALABARZON or NCR.
  • Declared State of Calamity by a local government unit (LGU) covering Calamba, Laguna, or by the national government covering the Guest's origin region.
  • Earthquake: PHIVOLCS-recorded earthquake of Intensity VI (PEIS) or magnitude 6.0 or higher whose epicenter is within one hundred (100) kilometers of the property, or any earthquake that renders the property structurally unsafe per a qualified engineer's assessment.
  • Road closure: DPWH, MMDA, or LGU closure of SLEX, STAR Tollway, or primary feeder routes to Pansol for twelve (12) hours or more.
  • Property utility outage: continuous failure of grid power (Meralco) or municipal water supply at the property for twenty-four (24) hours or more.
  • Government or regulatory order prohibiting travel, gathering, or commercial accommodation operations that materially affects the booking.

4.3 Remedies

When a Force Majeure trigger fires for a booking within the next seven (7) days or during the stay, the Guest may reschedule the booking once, free of the fifty percent (50%) rescheduling fee that would otherwise apply under section 2, to new dates within thirty (30) days of the original arrival date, subject to availability. The Guest should confirm the new dates within forty-eight (48) hours of our written notice. A rate differential applies if the new dates fall in a higher-tier season; we do not refund the difference for a lower-tier rebook.

All payments remain non-refundable and this clause does not provide a monetary refund. Because a reschedule does not compensate for third-party or consequential losses (for example non-refundable transport), we recommend that Guests carry travel insurance.

4.4 What Force Majeure does not cover

  • Personal weather anxiety or media coverage where no listed trigger has fired. The Guest's subjective concern about a forecast does not invoke this clause.
  • Third-party transport cancellation (airline, ferry, ride-share) where the property remains operable and no CBP-side trigger has fired. The Guest carries the transport risk.
  • Retroactive claims made more than forty-eight (48) hours after a trigger has ended without prior written notice during the trigger window.
  • Consequential and third-party losses — the Force Majeure remedy is a reschedule of the villa booking only. It is not a monetary payment and does not cover non-refundable transport, deposits with other vendors, or other consequential losses, which remain the Guest's risk and a matter for the Guest's own travel insurance.

4.5 Notification and documentation

We monitor PAGASA and PHIVOLCS bulletins during cyclone and seismic events. When a trigger fires for a booking within the next seven (7) days, we notify the Guest within six (6) hours via Viber and email, citing the bulletin or order, explaining the reschedule remedy in section 4.3, and stating the forty-eight (48) hour deadline to confirm the new dates. Guests are likewise encouraged to monitor PAGASA (pagasa.dost.gov.ph) and PHIVOLCS (phivolcs.dost.gov.ph).

4.6 Civil Code basis

This clause supplements, and does not replace, the general rule in Article 1174 of the Civil Code of the Philippines that no person shall be responsible for events that could not be foreseen or that, though foreseen, were inevitable. The triggers above are an agreed concretization of that rule for the property-specific risk profile of Pansol, Laguna.

5. House rules

  • Smoking. ₱5,000 fine per villa; designated smoking areas only.
  • Outside food and beverages. Outside food and beverages welcome at no corkage. Catering (mobile bars / food trucks) is chargeable; please notify reservations 3 days in advance.
  • Quiet hours and curfew. No quiet hours, no curfew. Guests remain responsible at all times for not disturbing neighboring villas and the surrounding residential community.
  • Pool safety. Children must be supervised by an adult at all times near and in the pool. No lifeguard is on duty. No glass containers in or beside the pool.
  • Pets. Pets are accepted only with prior written approval and may incur an additional cleaning fee. Service animals are exempt.
  • Illegal activity. The sale, use, or transport of illegal drugs, firearms, or any activity that violates Philippine law is strictly prohibited and will result in immediate termination of the stay without refund, plus notification to the appropriate authorities.
  • Photography and filming. Personal photography is welcome. Commercial photography, filming, drone operation, or social-media production for paid work requires prior written approval and may be subject to a location fee.

6. Damage and breakage policy

Guests are billed for any repair costs from damages during stay. On arrival, the Guest is presumed to accept the villa, fixtures, appliances, and furnishings as being in good order unless damage is reported in writing to the on-property host within two (2) hours of check-in.

On departure, our housekeeping team conducts an inspection. Damage, missing items, and beyond-ordinary soiling are billed at replacement or repair cost plus a ten percent (10%) administration fee. Documented evidence (photographs, receipts) is provided to the Guest within seventy-two (72) hours.

For groups of fifteen (15) or more, or for events involving alcohol service, we may require a refundable damage deposit of ₱5,000 to ₱20,000 collected on arrival and refunded within seven (7) banking days of a clean check-out.

7. Limitation of liability

CBP, its directors, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of enjoyment, or loss of business opportunity, arising out of or in connection with the booking or stay, whether in contract, tort, or otherwise.

Our aggregate liability for any and all claims arising out of a single booking, to the maximum extent permitted by Philippine law, is capped at the total amount actually paid by the Guest for that booking. This cap applies whether the claim is brought in contract, tort, statute, or otherwise.

Nothing in these Terms excludes or limits liability for (a) death or personal injury caused by our gross negligence or willful misconduct, (b) fraud or fraudulent misrepresentation, or (c) any liability that cannot be lawfully excluded or limited under Philippine law, including the consumer-protection floor under Republic Act No. 7394 (Consumer Act of the Philippines).

Personal property. We are not liable for loss, theft, or damage to personal property brought onto the premises. Guests are responsible for securing valuables. We provide standard locks on villa entrances but do not operate a safe-deposit service.

Activities at own risk. Use of the pool, hot-spring water, BBQ pit, kitchen, and any on-property recreation is at the Guest's own risk. The Guest accepts responsibility for supervision of children and any guests in their party.

8. Guest indemnity

The Guest agrees to indemnify and hold harmless CBP from any third-party claim (including from other members of the Guest's party) arising out of (a) the Guest's breach of these Terms, (b) the Guest's violation of Philippine law on the premises, or (c) damage caused by the Guest's negligence or willful misconduct, subject to the same liability cap as section 7 applied in reverse.

9. Data privacy

Personal data collected in connection with the booking is processed in accordance with our Privacy Notice and the Philippine Data Privacy Act (Republic Act No. 10173). Booking records are retained for ten (10) years to satisfy the BIR books-and-records requirement, after which personal identifiers are anonymized.

10. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising out of or in connection with these Terms shall be brought exclusively before the proper courts of Calamba City, Laguna, to the exclusion of any other venue, save where Philippine law mandates a different venue (for example, consumer disputes that may be filed at the Guest's residence under the Consumer Act).

Before initiating litigation, the parties agree to attempt to resolve any dispute in good faith through written correspondence for a period of thirty (30) days. This does not preclude either party from seeking urgent injunctive relief.

11. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect. The unenforceable provision is replaced by an enforceable provision that most closely reflects the original commercial intent.

These Terms, together with the booking confirmation and our Privacy Notice, constitute the entire agreement between the Guest and CBP relating to the booking and stay, and supersede any prior verbal or written understandings on the same subject matter.

12. Updates to these Terms

We may revise these Terms from time to time. The version applicable to a given booking is the version in force on the date the booking is confirmed in writing. Material changes are communicated by email to Guests with active bookings and posted on this page.
